Ways to Overcome Copyright Problems

In this age of instant communication, more and more ideas are being born and products created than ever before. With the current entrepreneurial trend, new business owners are creating never-before-seen content and services in order to better the world. With so much going on, it can be easy to create something that copies another person a little too closely. Luckily, there are several steps that can be taken to overcome copyright issues.

1. Get permission from the original owner.

When it comes to using copyrighted content, the only legal way to make use of the content is to contact the original owner and ask for permission. In the event this is impossible, there are websites like Creative Commons that offer royalty-free image and audio files that are free for commercial use.

2. Trademark and copyright your own content.

If you create something you intend to turn into a business or revenue stream, it is important to obtain legal rights to it. While it may be your intellectual property, you cannot prevent someone from creating a similar idea and starting a business based on it. It’s important to trademark and copyright your ideas in order to protect them.

3. Obtain a legal copyright.

Intellectual property can be copyrighted by simply putting the copyright symbol in front of it with your name. However, the Copyright Act covers certain topics that are not so easy to claim ownership of, including architectural and choreographic works. Speaking to a copyright lawyer is the way to go to properly claim ownership of your own work and prevent illegal copying of it.

4. Trademark your property.

A trademark differs from a copyright primarily in the things it protects. While a copyright is usually used to cover a creative work, trademarks are used to protect names, logos, symbols, and other corporate IPs. The process of trademarking a property is lengthy and complicated, so it’s best to consult professional help. You must first search to ensure no similar trademarks exist to the one you want to file; even if an existing trademark isn’t identical, one that is too similar can make it impossible for you file.

5. Remember: registration isn’t absolutely required.

Since 1978, there has been no formal requirement in the United States for copyrighted work to bear the copyright symbol. A novel, for instance, is protected as soon as it is ‘saved’ in a word document. That said, registering the work offers certain protections that proprietary copyrighting does not. A person can only sue over copyright issue if their copyright is registered. The restitution a person may receive for damages will only count after the content is registered, not before.

While it may be an extra step, taking the time to copyright and trademark your property, whether intellectual or physical, can protect it in ways that claiming ownership cannot. Copyright issues can pose a number of problems for content creators or those who want to use content, but knowing how to overcome this problems before they arise can prevent a lot of headaches.

Are Your Circumstances Suitable for a Collaborative Divorce?

You may be suitable for a collaborative divorce if you seek:

  1. A dignified approach to handling your divorce
  2. A fair and non-aggressive resolution of issues based on the best interests of the family, not the individual
  3. Guidance, support and advice on legal issues without the threat of fighting in court.
  4. A chance to work through emotions and avoid misunderstandings to arrive at sound decisions
  5. To avoid the cost and emotional strain of court proceedings
  6. To keep your dispute and terms of your settlement confidential

How do I kick start the process?Contact a collaborative divorce lawyer. You must choose a lawyer trained in collaborative family law for the process to be effective. An experienced lawyer knows about the required documentation that can make process hassle free.

What happens when we reach agreement?

After you reach agreement, your lawyer can prepare divorce papers that the court is likely to approve.

What happens if the process breaks down?

You may explore other options such as mediation to avoid from going to court. However, if you do take your case to court, your collaborative lawyer cannot act on your behalf in court proceedings as they have signed an undertaking not to litigate.

What is the difference between the collaborative divorce process and court litigation?

Collaborative divorce is a voluntary process that gives divorcing parties control over the process, including the timetable. On the other hand, the litigation process is controlled by the judge and determined by court dates, and parties must comply with the court’s orders. Divorce Lawyers will facilitate direct negotiations between parties in collaborative divorce, working towards a common goal that is in the best interests of both parties and the family, and parties will be encouraged to consider short- and long-term impacts of their decisions. In litigation, both parties and lawyers are pitted against each other, and parties will bargain based on their own needs and rights. They will not be actively asked to think about the short- and long-term effects of their choices.

As can be seen, collaborative divorce allows the parties, instead of the judge, to make the final decisions. Due to this, however, there is no guaranteed settlement in collaborative divorce. If parties cannot reach a final decision, they will need to proceed with litigation. The process of collaborative divorce is confidential, but if parties enter into litigation, the records of Court proceedings will be publicly available.

The Ways to Improve Fundraising

Donor management is never easy no matter how easy it may seem; there is always some information that you will need to get and some that you will need to impart in order to learn some of the best ways of it.

In the many things about donor management the one that counts to be the most important of all is improving fundraising and getting into the skills of it all for the best results. Here in this article are the ways you need to follow and imbibe to improve the fundraising program for your nonprofit or church.

1. Be Transparent with Your Donors – Though this might seem like an obvious point, it is usually the one that is most ignored, and the most important of all. What is important about transparency is your donors being able to trust you with all – from your plans to our ideas and ideologies. Also, this is an important point to note because only when they trust you will they be able to steward their money well and you must be able to show them you are doing so. By ‘transparent’ we mean both financial and program transparency.

Financial Transparency: You might not be considering financial transparency to be an important point but this should definitely be on your list of important things. It is considered important to release a note time to time which would show how you are allocating your funds, but your donors are not going to sit and read through that long document. Make sure you give your donors an easy way to digest how you are investing their money. Create a graph, chart, infographic etc. And if it looks like you spent more in say, fundraising, than expected, explain why. Your donors love your mission and giving them a peek behind the curtain creates a sense of belonging and teamwork.
Program Transparency: Program transparency is all about the IMPACT. If you can show your donors the impact their money has made in changing the lives of those you’re serving or where the money has impacted, you can be sure you’ve done your thing right. Create annual reports showing the graphs of how far you’ve come with the support, meanwhile mentioning exactly where you want more changes and where you’re striving to achieve more.

2. Optimize our Donor Experience – Your donors shouldn’t be there for just one years or only a period of time, and that is possible only if you manage to optimize the donor experience convincing them that there are things that’ll help you stay in contact for more than one donation period. Try personalization (which definitely does no longer mean just hey and the first name); it is always recommended to stay in touch with the donors through emails, letters and phone calls. You can segment based on last gift amount, last gift date, a specific campaign – anything. And then create fundraising messaging around each category.

3. Audit Your Systems – Thought this is not important? Wrong!!! One of the most important points to be considered to improve fundraising is to audit your system – audit on your end – use the right set of tool and the right techniques. Keep the audit impartial and keep it clear – this will help you understanding how far you’ve come with your fundraising program and exactly how far you will be able to go with it.

Fundraising for churches, charities and non profits is the thing that does the most benefit and an increase in the finds over a stipulated period of time is exactly what they’re striving for. It is therefore recommended that you use these set of tips mentioned above and create a draft accordingly of you new ideas and plans for an increase in the funds.

How a Pleasant Shopping Experience Can Make Your Day

Would anyone in this world be jubilant about spending at least 2.5 hours in a grocery store? Well, I can honestly say, “I would not.” However, my shopping experience today was a very satisfying.

To begin, to put this experience into context, let me describe for you our new, enormous marketplace grocery store that recently opened in our neighborhood. This store has almost everything that one might desire. First and foremost, for me, there is a coffee shop, not to mention a wine bar, where you can stop and have a drink of wine and socialize before or after your shopping experience. Once you have tackled your grocery list, if there is just a little left over in your budget, you can treat yourself to a piece of clothing or a pair of shoes.

Now that I have set the tone of my experience, let me move on to the gist of my article, why in the world did this shopping experience last 2.5 hours. Well, to begin, I had just returned from an early morning medical appointment and I had not had my morning cup of java and anyone that knows me, can understand why that would be a problem. So, my first stop was the coffee shop. Once, I had my first sip, I was good to go. However, my stomach alerted me that the shopping experience would not be good, if my hunger was not satisfied. Just in the nick of time, while at the food deli, I was greeted by one of the store employees and I questioned her about breakfast foods. She immediately pointed me into the direction of a rack where there was one large Meat Lover’s Burrito left. Without hesitation, I grabbed the burrito, returned to the coffee area to eat it.

Now that my hunger had been satisfied, I moved on to the vegetable and fruit area. While picking out my vegetables, there was another shopper who had on nautical clothing. So, I kindly mentioned to her that her attire would be the perfect outfit for me, as I am planning to go on a cruise in a few weeks. She responded and we socialized for just a little bit. I noticed that she was removing her earrings and without hesitation, she gave them to me and went on to explain her reasoning. She thought they would go very well with my cruising experience, as the theme was, of course, nautical. I stated that I could not accept her earrings; however, she insisted because she indicated she had another pair exactly like this pair. Remembering what my mother taught me, “to always be humble and graciously, thankful for any gift that I receive.” So, I thanked her for the gift and mentioned that I would tuck them away in a safe place until my trip.

Moving on, my next area would be the gourmet cheese section and there I met another shopper where her and I discussed the various cheeses that was displayed in the counter. She, pleasantly, began to share with me her experience with cheese and she sounded like a “cheese expert” to me. I should have mentioned early in the article that my family deemed a “social butterfly” early in life and I have lived up to that reputation since then. So, our conversation continued for well over 15 minutes, of course, drifting off to several other topics. After a while, we shared what area of the community that we lived in and would you believe that she turned out to be my neighbor, whom I had met approximately four years ago. We both moved into the community around the same time. Subsequently, we shared our contact information, once again, and both of us decided that we needed to get back to shopping and agreed to stay in touch.

Finally, my grocery shopping was all done and I proceeded on to the check-out counter. In conclusion, my hope is that by sharing my experience, it will challenge others to take the time to reach out to others. Extend a friendly compliment to someone, or pay it forward; and, hopefully, the positive experience will help set a tone for the rest of your day, as well as the other individual with whom you interacted.

Preparing for Cyberspace

While cyber security is an important issue for boards, it has not always been top of mind. Because a major corporation like Equifax had a breach in its IT system, many companies are rethinking how to secure cyber security.

Boards around the world are examining the Equifax case to determine how to best secure their organizations valuable information stored in their IT systems. So who is responsible? Since the CEO has stepped down, it is apparent he was being held accountable. However, where was the board of directors?

In today’s world of cyberspace, corporate boards have to think about more than governance, CEO compensation and strategy.

As it stands, it is in the board’s best interest to ensure the company is not exposed to debilitating risks. Companies have workplace safety standards and sexual harassment policies to mitigate lawsuits. They even have disaster recovery plans in the event of natural disasters or occurrences like the World Trade Center plane crash. These plans and policies are in place to keep business running smoothly and perpetually. It protects customers and employees.

However, with sophisticated computer hackers around the world, it is no news that computer systems and valuable information can be breached and stolen. There are hackers who breach computer systems as a business. They ask for ransom in the amount of tens of millions of dollars. If it is not paid, they threaten to release the companies secure information, which sometimes could contain private email communication from top executives.

While many enterprises as large as Equifax may have disaster recovery plans for their physical operation, they may not have the same plan for cyber breach. The disaster recovery policies would include immediate action steps based on size of the breach, who made the breach, what information was taken, were company smart phones breached, what to communicate to employees, the public and shareholders as well as other important factors.

In some cases, it may make sense to inform the FBI. In other cases, it may be better to pay the ransom. The challenge with calling the FBI is that the hackers could be in countries like Russia. In Russia, the FBI may not pursue them. Why? Because the Russian government is always looking for good hackers. If the FBI exposes the hackers in Russia, the government may hire them, which can present long-term problems for the US. When it comes to paying ransom, it’s tricky. If you pay, they may hack you again as though you are an ATM machine. If you don’t pay, they may expose confidential information. These are also the kinds of challenges that directly involve the board.

What’s most important is that the board is talking about cyber security before there is a problem. There should be constant audits of the cyber security system to mitigate any risks. In addition, as a board, they should hold the CEO accountable for that security. Furthermore, there should be clear policies to guide the board and the executive team on how to handle the various moving parts in a delicate situation. Boards with disaster recovery plans and high accountability with the CEO are more likely to be forward thinking about cyber vulnerabilities and proactive about updating the security system.

All of that changed during the real estate boom of the mid-1990’s and since that time, the run on Mt. Washington homes for sale has been akin to the California Gold Rush. What Is Tort Law Exactly?

Have you ever done something that was against the rules? Well, torts are something like that; but much more serious. Torts are civil wrong-doings; immoral behaviors and actions against civilians. The law identifies a tort as immoral, and approves it as grounds for a lawsuit. Most often, torts come with severe consequences, like serious injuries and death. These consequences establish a civilian’s right to file a personal injury claim against a wrongful party.

Torts that result in serious injury or death can be punishable by imprisonment; however, the objective of tort law is to acquire compensation for damages incurred by victims and families of victims. In addition, and equally important, intent is to prevent similar wrongdoings from occurring in the future. In fact, victims of tort can take legal action for an injunction in order to inhibit further torturous conduct of the opposing party.

Explaining Torts and Tort Law

Victims of tort can pursue fair compensation for damages incurred as a result of the offence. Exemplary damages include everything from pain and suffering to loss of companionship, and much more; such as lost wages, hospital bills, medical expenses, scarring or disfigurement, funeral expenses, prolonged rehabilitation, permanent disabilities, and much more. Injured victims can also pursue compensation for damages like diminished quality of life and loss of benefits from loved one’s death. Tort law is established to protect injured victims that were wrongfully hurt by a negligent party. Negligent parties can include people, companies, individuals, organizations, products, and much more.

Categories of Tort

There are several individual capacities of tort law that all depend on the type of injury or accident that harms a person. Types of tort include motor vehicle accidents, product liability, assault and battery, sexual harassment, drunk driving accidents, wrongful death, slip and falls, head or brain injuries, dog bites, nursing home neglect, motorcycle accidents, and several other types of deliberate inflictions of emotional or physical trauma.

Every type of tort can be grouped into three separate categories of tort law; these categories are Intentional Torts, Negligent Torts, and Strict Liability Torts. Intentional torts are deliberate, premeditated, and purposeful. Assault and battery, sexual misconducts, and nursing home neglect are some examples of intentional tort. Negligent tort occurs as a result of carelessness and disregard. Disobeying traffic signals and causing an accident that harms another person is an example of negligent tort. Other examples include pedestrian accidents, hit-and-run accidents, medical malpractice, legal malpractice, and slip and fall accidents. Strict liability torts, on the other hand, occur when a particular action causes harm or damage to another person; such as liability for making and selling defective products that are hazardous.

If you are a victim of tort, or was recently injured in an accident caused by the negligence or misconduct of another party, you may be entitled to compensation for your damages. Contact a licensed personal injury law firm for professional guidance and counsel. It is important to take immediate action following a serious injury before the State’s statutes of limitation runs out. An experienced tort lawyer will substantially increase your chances and likelihood of winning your personal injury claim recovering compensation for your damages.
